Acceptance

By accessing riverbendfun.com, related subdomains we operate, or any feature that links here (collectively, the “Services”), you agree to these Terms and our Privacy Policy. If you disagree, stop using the Services.

Operator and affiliation

Varry LLC publishes the Services as an unofficial River Bend–themed visitor showcase: telemetry, trip planning, activity boards, illustrative maps, classified tooling, and (on a separate subdomain) community discussion. Everything is for experimentation and community storytelling—not a substitute for HOA operations, licensed engineering, or regulated professional services.

River Bend Membership Corporation (“RBM”) is legally separate from Varry LLC. Unless RBM’s authorized representatives expressly endorse a specific deployment in writing, there is no sponsorship or agency relationship. HOA-only matters—membership, dues, docks, gate rules, clubhouse reservations, ballots, architectural review, resale packages, insurance, and counsel—must be handled solely through official RBM channels.

Community subdomain (FluentCommunity)

Member discussion may be offered at a community subdomain (for example, community.riverbendfun.com) using the FluentCommunity WordPress plugin. That space has its own feeds, profiles, and moderation tools. By participating you also agree to FluentCommunity’s terms and privacy policy to the extent they apply to the plugin and hosting stack.

Community rules — you agree not to:

• Harass, threaten, dox, or discriminate against others.
• Impersonate RBM staff, Varry LLC, neighbors, or officials.
• Post content you lack rights to share (copyright, trademark, private HOA records, or confidential resale packages).
• Upload malware, spam, or solicitations that violate RBM rules or applicable law.
• Use the community to conduct official HOA business, binding votes, or legal notices on behalf of RBM.

Moderators may remove content, restrict accounts, or ban repeat offenders. Community decisions are operational, not HOA enforcement. Report safety emergencies to appropriate authorities, not only to forum moderators.

Weather and river email alerts

Signed-in users may opt in to informational emails when NWS headlines or USGS reference gauges cross configured thresholds. Alerts are sent by Varry LLC via EmailIt from support@riverbendfun.com. They are not emergency dispatch, official RBM flood notifications, or a substitute for NOAA Weather Radio or local emergency services. Manage preferences on the community site profile. Disabling alerts there stops future messages of that type.

Informational use only

Live and demo widgets—including weather, river gage snippets, commute scenarios, map overlays, listings aggregates, water-quality context, and app-demo UX—are illustrative. They do not replace stamped engineering, certified flood data, NOAA alerting, legal advice, appraisals, MLS listings, or insurance underwriting. USGS and similar feeds may be provisional; corroborate with authoritative sources before relying on them for safety or property decisions.

Accounts and acceptable use

Optional accounts on the main site use Better Auth and infrastructure we control. Credential stuffing, scraping that harms infrastructure, malware distribution, or circumventing access controls violates these Terms and may lead to suspension.

User content and copyright

You represent that you have the right to post any content you submit (classifieds, community posts, service provider listings, member reviews of local contractors, comments, images). You grant Varry LLC a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt for formatting, and moderate your content solely to operate the Services. You may not use our branding, logos, or templates to imply official RBM endorsement.

We respect intellectual property rights. If you believe material on the Services infringes your copyright, contact the stewardship address for this domain with identification of the work, the URL, and a good-faith statement. We may remove or disable access to disputed material and terminate repeat infringers where appropriate.

Map parcels, tax identifiers, and telemetry come from public or licensed third-party sources (county GIS, USGS, Esri tiles, etc.). Redistribution of bulk datasets or use of Esri/MapLibre assets outside permitted terms is prohibited.

Third-party services

The Services integrate external APIs, CDNs, fonts, and data providers. Your use of those features is also subject to the applicable vendor terms, including without limitation:

• USGS / NOAA / NWS — NWS disclaimer; USGS data are provisional unless otherwise marked
• EPA ECHO & Water Quality Portal — public API terms as published by EPA
• Esri — Master agreement (map tiles)
• MapLibre GL JS — BSD licence in upstream project
• Google Fonts & Font Awesome — respective CDN/font licences
• Maryland DOT CHART & West Virginia 511 — official traffic camera feeds on /travel; not for emergency routing; subject to each agency's terms and stream availability
• RentCast — Terms when listings API is enabled
• Peekshot — API terms in Peekshot account (share-card rendering)
• FluentCommunity / WPManageNinja — Terms

We are not responsible for third-party outages, policy changes, or accuracy of external data. Links to official RBM, government, or recreation sites are provided for convenience and do not imply endorsement by those entities.

Disclaimer of warranties

EXCEPT WHERE PROHIBITED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARRY LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF USE OF THE SERVICES, EVEN IF ADVISED SUCH DAMAGES WERE POSSIBLE.

Indemnity

You indemnify Varry LLC from third-party claims tied to your content, account activity, or breaches of these Terms—including claims that arise when illustrative pages or community posts were treated as official HOA documentation when they were not.

Governing law

West Virginia law governs disputes with Varry LLC about the Services, without regard to conflict-of-law rules that would force another forum, except where mandatory consumer protections in your place of residence apply.

Changes

Varry LLC may update these Terms by posting revisions with a new effective date. Continued use after changes constitutes acceptance unless stronger consent is required by law. Material community-policy changes may also be announced on the community subdomain.
